These Marketplace Terms of Service ("Terms") govern your use of the Cryo Lab Marketplace, a platform for distributing and downloading Node.js modules and Vue.js projects designed for use with Cryo Lab. By accessing or using the Marketplace, you agree to be bound by these Terms.
2. Definitions
"Marketplace" refers to the Cryo Lab Marketplace platform and associated services
"Package" refers to any Node.js module, Vue.js project, or other software distributed through the Marketplace
"Publisher" refers to any user who uploads or distributes Packages on the Marketplace
"User" refers to any person who accesses or uses the Marketplace
3. Account Registration
To publish Packages on the Marketplace, you must:
Create an account with accurate and complete information
Maintain the security of your account credentials
Accept responsibility for all activities under your account
Promptly notify us of any unauthorized use of your account
4. Publisher Responsibilities
4.1 Content Ownership
By publishing a Package, you represent and warrant that:
You own or have the necessary rights to distribute the Package
The Package does not infringe any third-party intellectual property rights
You have obtained all necessary permissions for any third-party components
4.2 Package Quality
Publishers must ensure their Packages:
Are functional and as described
Do not contain malware, viruses, or malicious code
Include accurate documentation and version information
All Packages must include a clear license. Publishers are responsible for:
Selecting an appropriate open-source license
Ensuring license compatibility with dependencies
Maintaining license files within the Package
5. User Responsibilities
Users of the Marketplace agree to:
Use downloaded Packages in accordance with their respective licenses
Not attempt to reverse engineer, decompile, or extract source code from compiled Packages unless permitted by the license
Report any security vulnerabilities or malicious Packages
Not use the Marketplace for any unlawful purpose
6. Prohibited Content
The following content is strictly prohibited on the Marketplace:
Malware, viruses, trojans, or any malicious software
Content that infringes intellectual property rights
Illegal content or content promoting illegal activities
Content containing hate speech, harassment, or discrimination
Spam, misleading content, or deceptive Packages
Content that collects user data without consent
Packages with intentionally harmful or destructive functionality
Warning: Violation of prohibited content rules may result in immediate removal of Packages and permanent account suspension.
7. Intellectual Property
7.1 Publisher Rights
Publishers retain all intellectual property rights to their Packages. By publishing on the Marketplace, you grant us a non-exclusive, worldwide license to host, distribute, and display your Package.
7.2 Marketplace Rights
The Marketplace platform, including its design, features, and content (excluding user-submitted Packages), is owned by Patrice Chevillat and protected by intellectual property laws.
8. Package Removal
We reserve the right to remove any Package that:
Violates these Terms or the Publishing Guidelines
Contains security vulnerabilities that pose a risk to users
Is subject to a valid intellectual property complaint
Has been abandoned and poses compatibility issues
Publishers may also remove their own Packages at any time, though previously downloaded versions may remain on user systems.
9. Disclaimer of Warranties
The Marketplace and all Packages are provided "as is" without warranties of any kind. We do not guarantee that:
Packages will be error-free or suitable for any particular purpose
The Marketplace will be available without interruption
Downloaded Packages are free from security vulnerabilities
10. Limitation of Liability
To the maximum extent permitted by law, neither we nor any Publishers shall be liable for any indirect, incidental, special, consequential, or punitive damages arising from:
Your use or inability to use the Marketplace
Any Package downloaded from the Marketplace
Unauthorized access to your data or transmissions
Any bugs, viruses, or errors in Packages
11. Indemnification
You agree to indemnify and hold harmless Patrice Chevillat and the Marketplace from any claims, damages, losses, or expenses arising from:
Your violation of these Terms
Your Packages (if you are a Publisher)
Your use of any Package from the Marketplace
12. Changes to Terms
We may update these Terms at any time. Material changes will be communicated through the Marketplace or via email. Continued use after changes constitutes acceptance of the new Terms.
13. Termination
We may terminate or suspend your access to the Marketplace at any time for violation of these Terms. Upon termination:
Your right to publish Packages ends immediately
We may remove your Packages from the Marketplace
Downloaded Packages on user systems are not affected
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Switzerland. Any disputes shall be resolved in the courts of Zurich, Switzerland.
